PERANAN PENYIDIK DALAM PENERAPAN PRINSIP RESTORATIVE JUSTICE KEPADA ANAK SEBAGAI PELAKU PELANGGARAN KECELAKAAN LALU LINTAS (STUDI PELAYANAN PEREMPUAN DAN ANAK POLRES 50 KOTA)

Abstract

Children who commit violations of traffic accidents according to Article 5 paragraph 1 of Law Criminal Justice System Child resolved in restorative justice. But in reality children as perpetrators of traffic accidents in the 50 State Police investigators have not fully resolve the matter in restorative justice. The formulation of the problem is: (1) What is the role of the investigator in applying the principles of restorative justice for children as perpetrators of violations of traffic accidents? (2) Are the constraints investigators in applying the principles of restorative justice for children as perpetrators of violations of traffic accidents?. This research method is a juridical sociological. The data source is primary and secondary data. The data collection technique was interview and document study. Data were analyzed qualitatively. Conclusion The results of the study are (1) The role of the investigator in applying the principles of restorative justice for children as perpetrators of violations of traffic accidents will only happen if both parties agree to terms with mutual forgiveness. (2) Constraints faced by investigators in applying the principles of restorative justice for children as violators of traffic accidents is happening as there was no agreement on the perpetrator or his family with the victim or his family.
