PENERAPAN PIDANA TERHADAP TINDAK PIDANA YANG MENGGUNAKAAN ZAT BAHAN YANG BERBAHAYA DALAM PEMBUATAN MAKANAN (Studi Perkara: Nomor 301/Pid.sus/2013/Pn.Dpk.)

ABSTRAK
In Law No. 36 Year 2009 on Health Article 111 paragraph (6), which reads food and beverages that do not comply with the standards, health requirements, and / or harm to health as referred to in paragraph (1) shall be prohibited for circulation, withdrawn from circulation, marketing authorization revoked and confiscated to be destroyed. In criminal cases the use of substances hazardous materials in the manufacture of food in case No. 301/Pid.Sus/2013/Pn.Dpk, sentenced to 8 months in prison or a prison 10 months probation. The problems: 1) how the application of criminal offenses against the use of substances hazardous materials in the manufacture of food in case Number 301/pid.sus/2013/pn.dpk? 2) How consideration of the judge on criminal acts that use substances hazardous materials in the manufacture of food in case Number 301 / pid.sus / 2013/pn.dpk? This study uses normative juridical approach. Legal materials studied were the Court's Decision No. 301/pid.sus/2013/PN.Dpk. legal materials collected by the study of the document, and then analyzed qualitatively. 1) Application of the criminal in this case, namely Article 136 jo. 75 of Law No. 18 of 2012 on Food. The defendant was sentenced to 8 months in jail or 10 months of probation. 2) consideration of the judge in this criminal act the defendant was found guilty based on the public prosecutor's indictment, and has met the elements of Article 136 letter b jo. 75 Law No. 18 of 2012 on food.
