PELAKSANAAN PUTUSAN HAKIM TERHADAP NAFKAH IDDAH DAN MUT'AH PADA KASUS CERAI TALAK DI PENGADILAN AGAMA KLAS 1A PADANG

ABSTRAK
Divorce happens because of the divorce from her husband, the court may oblige the former husband to provide cost of living in the form of a living iddah and mut'ah. The research problem is: (1) How is the implementation of the decision of the judge about living iddah and mut'ah in divorce cases divorce in the Religious Class 1A Padang. (2) What is the rationale for the judge in determining the amount of maintenance iddah and mut'ah. (3) Are the barriers to the implementation of the verdict against living iddah and mut'ah in divorce cases divorce in the Religious Class 1A Padang. This research uses juridical sociological research. Sources of data are the primary data and secondary data. Data collected through interviews and document study. After the data was analyzed qualitatively. RESULTS: (1) Livelihoods iddah and mut'ah husband paid before the oath of divorce. (2) The basis for consideration of the judge in determining the amount of maintenance iddah and mut'ah is appropriate capabilities and needs of the wife's husband. (3) obstacles in the implementation of the judge's ruling, the husband does not want to implement the judge's decision voluntarily, for the judge would delay the divorce pledge for 6 (six) months. This is done to protect the rights of the wife on living iddah and mut'ah.
