ABSTRACT

 

According to Minangkabau’s society, marriage is the most complex transition period consisting of physics, psychic, and sociology factors, also status as a sole individual. Minangkabau’s society follows the exogami marriage pattern at the limit of exogami ethnic. Minangkabau’s society is prohibited to marry someone from their own ethnic group. All of this matter is organized in the Nan Babuhua Mati which has the penalty to be kicked out of their ethnic group. In fact in Nagari Air Manggih there is people married between etnic groups. And also is explained Wali Nagari’s statements, tokoh adat and tokoh agama, about the punishment of  the costum, and how to implementasion it. The kind of punishment is threw away and it can not to bergai. People whom married between etnic groups have to receive a heavy punishment without defend his self. Therefore in implementation, this punishment is can not to refused and must be hold. People have to receive this punishment to far away from his village. And also the member of society is will supported this decision because the costum’s punishment have to do. To solve the problem that had make is needed to do research the characteristic of method is analysis of descriptive, that is used to describing, studing, and explaining way of valid regulation. In this research used the nearest yuridical of sosiologis, that is describing the research of marryage’s law of Minangkabau costum with moeslim marrige’s law. On the basis of this research, it can be concluded that the custom punishment to the one who get married to the person from their ethnic group in Nagari Aia Manggih had proceed for a long time now. The implementation of the punishment is running appropriately. The ancestors as the traditional guardian are still continuing the implementation of the punishment to the one’s marrying their ethnic group. Agree or disagree, the punishment that is given must be done.

PENERAPAN SANKSI ADAT TERHADAP KAWIN SASUKU

DI NAGARI AIA MANGGIH KECAMATAN LUBUK SIKAPING

ABSTRAK

 

Menurut masyarakat Minangkabau, perkawinan merupakan masa peralihan yang paling kompleks yang mencakup faktor-faktor fisik, psikis, sosiologi serta status social individu. Masyarakat adat Minangkabau menganut pola perkawinan eksogami dengan batasan eksogami suku. Orang Minangkabau dilarang kawin dengan orang yang sasuku dengannya. Semua ini diatur dalam adat Nan Babuhua Mati yang memiliki sanksi dibuang sepanjang adat. Kenyataannya di Nagari Aia Manggih masih terdapat pelaku kawin sasuku. Disini dijelaskan juga pendapat Wali Nagari, Tokoh Adat, Tokoh Agama, tentang sanksi adat dan bagaimana penerapannya. Bentuk sanksi berupa dibuang sepanjang adat tidak dapat ditawar-tawar lagi. Pelaku kawin sasuku harus menerima sanksi berat ini tanpa bisa membela diri. Begitupun dalam penerapannya, sanksi ini tak dapat ditolak, harus dilaksanakan. Pelaku kawin sasuku harus menerima sanksi dibuang dari kampung halamannya. Masyarakatpun akan mendukung keputusan ini, karena sanksi

adat adalah putusan yang wajib di jalani. Untuk menjawab permasalahan yang dirumuskan perlu diadakan penelitian. Metode yang digunakan adalah bersifat deskriptif analisis yang digunakan menggambarkan, menelaah dan menjelaskan peraturan perundang-undangan yang berlaku. Dalam penelitian ini digunakan pendekatan yuridis sosiologis, yaitu memaparkan penelitian hukum perkawinan adat Minangkabau dengan hukum perkawinan Islam. Berdasarkan penelitian dapat disimpulkan bahwa sanksi adapt terhadap pelaku kawin sasuku di Nagari Aia Manggih adalah dibuang sepanjang adapt dengan kata lain dibuang dari kampungnya. Sanksi tersebut dijunjung tinggi masyarakat. Dalam penerapannya sanksi adat terhadap kawin sasuku ini berjalan sesuai dengan aturan hukum adat Minangkabau. Ninik mamak selaku pemangku adat, tetap melanjutkan penerapan sanksi adat kepada pelaku kawin sasuku. Suka atau tidak, sanksi yang diberikan harus dilaksanakan.
