PUBLIC PARTICIPATION IN THE ESTABLISHMENT OF LOCAL REGULATION IN PARIAMAN

ABSTRACT

Participation is growing in the political system, the provision of public space or a mechanism, to realize the mechanism of participation is an absolute requirement as democratization, participation, community participation can be interpreted as both individuals and groups active in the determination of public policy, participation is based on the notion that the sovereignty of a country is in the hands of the people, so that the implementation of the political power wielded by the people one of which can be done through participation. Law No. 12 Year 2011 on the establishment of legislation precisely in Article 96 does not regulate more about community participation of this article is only set on the right to give oral or written input in preparing or discussion of draft laws and draft regional regulations. Issues raised in this study were (1) What is the form of public participation in the establishment of Regional Regulation No. 7 of 2010 on Fees Market (2) what are the factors that are impediments to the absorption of public participation in the establishment of Regional Regulation No. 7 of 2010 Levies on Market. This research is a socio legal research. Data used include primary data and secondary data. Data are collected by questionnaires, interviews and document study. Data were analyzed qualitatively. Based on the results of this research is that the local government and the City Council pariaman not given adequate space in the community to be involved in the process of establishing local regulations both in government and in the parliament discipline, community involvement is only in the form of providing responses to the information received either for the purpose of receiving or reject the draft implementing regulations and local regulation. As for the factors inhibiting the absorption of public participation in the absorption of public participation in the establishment of local regulations in Pariaman City are as follows: (a) low public education factor (b) the proponent agency factors are less open to dating aspirations of the community (c) low motivation factor legislators Pariaman the aspirations of the people who entered the draft local regulations (d) Factor Party (e) Factor recruitment of members of parliament (f) Less use of experts (g) lack of transparency in government (h) Cultural barriers (i) Limitations time (j) funding limitations (k) technical constraints.

ABSTRAK

Partisipasi dapat diartikan sebagai keikutsertaan masyarakat baik secara individu maupun kelompok secara aktif dalam penentuan kebijakan publik. Partisipasi masyarakat dalam pembentukan peraturan perundang-undangan diatur dalam Undang-undang Nomor 12 Tahun 2011 tentang Pembentukan peraturan perundang-undangan. Masyarakat berhak memberikan masukan secara lisan maupun tulisan dalam rangka penyiapan atau pembahasan rancangan  undang-undang dan rancangan peraturan daerah. Permasalahan yang diangkat dalam penelitian ini adalah (1) Bagaimanakah bentuk peran serta masyarakat dalam Pembentukan Peraturan Daerah Nomor 7 Tahun 2010 tentang Retribusi Pasar? (2) Faktor-faktor apa sajakah yang menjadi hambatan dalam penyerapan peran serta masyarakat dalam pembentukan Peraturan Daerah Nomor 7 Tahun 2010 tentang Retribusi Pasar? Penelitian ini menggunakan pendekatan yuridis sosiologis. Data yang digunakan meliputi data primer dan data sekunder. Data dikumpulkan dengan menyebarkan kuesioner, wawancara, dan studi dokumen. Data yang terkumpul dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa pemerintah daerah dan DPRD Kota Pariaman belum memberi ruang yang memadai pada masyarakat untuk terlibat dalam proses pembentukan peraturan daerah.Keterlibatan masyarakat hanya dalam bentuk memberikan tangapan terhadap informasi yang diterima baik untuk maksud menerima maupun menolak rancangan peraturan daerah dan melaksanakan peraturan daerah tersebut. Faktor penghambat penyerapan partisipasi masyarakat dalam pembentukan peraturan daerah di Kota Pariaman adalah: (a) pendidikan masyarakat (b) instansi pemrakarsa kurang membuka diri terhadap aspirasi yang dating dari masyarakat (c) rendahnya motivasi anggota DPRD Kota Pariaman terhadap aspirasi masyarakat yang masuk mengenai rancangan peraturan daerah (d) partai (e) rekrutmen anggota DPRD (f) Kurang pemanfaatan tenaga ahli (g) Kurangnya transparansi pemerintah (h) Hambatan budaya (i) Keterbatasan waktu (j) Keterbatasan dana (k) Kendala teknis.
