PENYELESAIAN PERKARA TINDAK PIDANA RINGAN MELALUI MEDIASI DI POLRES KOTA PAYAKUMBUH

Abstract

Misdemeanor is a criminal offense does not have a major impact to the justice
system and law enforcement, have a low level of danger. Examination process
quickly and simply. Action committed is a misdemeanor offense and contained in
Book II of the Criminal Code, like penalty of less than four years, fines, does not
include an exception artcle, to a complaint and set in PERMA No: 02 of 2012.
This study aims to know the settlement of minor criminal offenses by mediation,
obstacles, and mediation prospect to solve the minor criminal act in
Payakumbuh Payakumbuh Police Departemen. This study using sociological
juridical approach with primary and secondary data. The results showed that to
complete minor criminal act by mediation considered better and local wisdom
suitable. Peace is in writing and signed by the parties and witnesses known by the
police. The obstacles are that demand for compensation is too big to victims,
limited mediator and public understanding of the law is still low. Mediation
Prospects will grow and gaining attention as a new legal guidelines. Handling
cases faster and lucrative litigants and and law enforcement officers.
