PRAKTEK PERTANGGUNGJAWABAN KEJAHATAN PERUSAHAAN (CORPORATE CRIME LIABILITY) DALAM KASUS BONGKAR MUAT BARANG DARI DAN KE ATAS KAPAL DI PELABUHAN

Abstract

In economic crimes, legal persons are subject to criminal law. Legal entities may
be charged of criminal responsibility (corporate crime liability). In practice rarely
legal entities or companies prosecuted as criminals. Many cases of loading and
unloading is done by the company, but rarely go to court. Issues raised in this
study are : (1) How evil accountability practices of companies (corporate crime
liability) in the case of loading and unloading of good from and to the ship in the
port. (2) Is accountability contraints crime enterprise (corporate crime liability)
with the occurrence of criminal acts in the case of loading and unloading of good
from and to the ship in the port. This study used socio legal approach. Date used
include primary date and secondary date. Date were collected through interviews
and document study. Date were analyzed qualitatively. The results showed that:
(1) Corporation, in principle, should be accountable to in the courts for the crimes
committed in the ship in the port of Teluk Bayur, good deeds done by the organs
of the corporate and other parties responsibility or people who work for corporate
interest. (2) Accountability is not only in the form of civil liability but may also be
criminally responsibility, but in practice it is difficult to be accountable for their
corporations because corporations always take legal action by way of settlement
out of court.
