OPTIMALISASI TUGAS DAN WEWENANG ANTARA KEPOLISIAN DAN KOMISI PEMBERANTASAN KORUPSI (KPK) DALAM PENYELIDIKAN DAN PENYIDIKAN TINDAK PIDANA KORUPSI
Abstract
Coordination of investigations and investigations conducted by the Commission andthe Police have in common in performing these tasks. Coordination is regulated in
Law Number 30 of 2002, Article 8 paragraph (2) of the Corruption Eradication
Commission. The fact that both the law enforcement and the Police Commission is
still visible lack of coordination in the examination and investigation of corruption.
The problem is: 1. How duties and authority of the Police and the Commission in the
investigation and investigation of corruption ?, 2. How Optimizing the duties and
authority of the Police and the Commission in the investigation and investigation of
corruption? This study using sociological juridical approach, the data used are
primary data and secondary data. Data was obtained through interviews, document
studies and analyzed qualitatively. The authority supervising the research results
owned by the Commission of its existence has the duty and function as a means of
power relations between the KPK and the police. Where one part of the supervision
that is taking over the handling of the case made by the Commission to investigators
previously considered no progress or development. Optimization of tasks and
responsibilities between the police and prosecutors in investigations and inquiries
carried out by the MoU on coordination of the task. As well as the cooperation
undertaken in the case of criminal investigations of corruption.
