Abstrak

This study provides an overview of the Legal Liability for Midwives Due to the Abundance of
Authority by Doctors in Health Services at the Health Center. Midwives providing health
services must be in accordance with competence, the authority to comply with a code of ethics,
professional standards, service standards, operational procedures standards and applicable
regulations. Midwives are tasked with providing maternal and child health services, midwifery
services, and carrying out the delegation of authority over medical measures. Health services
by midwives on the delegation of authority from doctors can also lead to errors and negligence
in actions such as malpractice cases, so that patients sue both criminal and civil. Therefore,
there is a need for legal accountability for midwives and doctors if it is not in accordance with
the standards, by looking at the elements of error, negligence, and default based on the medical
record.
